Terms of service

Last updated: 2026-05-07. These Terms constitute a binding agreement between you (the visitor) and the operator of mediabuyer.site. Please read them carefully — particularly the third-party content, acceptable use, and indemnification sections, which describe what you may and may not do with material you see on the Service.

1. Acceptance and parties

By accessing or using mediabuyer.site (the "Service") you agree to these Terms of Service ("Terms"). The Service is operated by the mediabuyer team ("we", "us", "mediabuyer"). If you do not agree to any part of these Terms, do not use the Service.

For users acting as consumers under EU and Spanish consumer protection law (including Royal Legislative Decree 1/2007, the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios — TRLGDCU), nothing in these Terms limits any mandatory protections you enjoy under that statute.

2. The Service: editorial and research purpose

The Service is an editorial publication and research index for the performance-marketing industry. It provides news reporting, comparison and benchmark pages, an index of publicly served native advertising creatives, calculators, glossaries, and related research surfaces. The Service is offered "as available" and is provided primarily for editorial, informational, and research purposes. The Service is not a content distribution channel and does not authorize downstream redistribution of third-party material indexed on it.

3. Eligibility and account

To create an account you must be at least 14 years old (the minimum age for valid consent under Spanish data protection law, LOPDGDD art. 7). You are responsible for the security of your credentials and for any activity under your account.

4. Third-party content and advertiser creatives

The ad index reproduces images, video frames, headlines, advertiser names, logos, trademarks, and metadata from native advertising creatives that were served publicly on third-party publisher properties. Those creatives, trademarks, and assets are the property of their respective advertisers, agencies, publishers, or other rights-holders. mediabuyer is an editorial index; we do not claim ownership of third-party creatives and we do not grant any license — express, implied, by estoppel, or otherwise — to copy, reproduce, redistribute, re-host, sub-license, or commercially reuse any of those third-party assets. Display on the Service is not, and must not be construed as, authorization from the rights-holder for any downstream use.

We index those creatives for purposes of news reporting, criticism, comparison, statistical analysis, and competitive research, relying on the limitations and exceptions to copyright in Arts. 32–37 LPI, Articles 3–5 of EU Directive 2019/790, and analogous fair-use principles under 17 U.S.C. § 107.

Advertisers and rights-holders who believe a specific creative should be removed should follow the procedure on the DMCA & takedown page. We respond within 24 hours.

5. Acceptable use

You agree that you will not:

  • Scrape, mass-download, mirror, or systematically copy the Service or any substantial part of it (including the ad index, its images, its metadata, or its ordering), whether manually or via bots, scrapers, headless browsers, AI crawlers, or any other automated means, other than search-engine indexing in compliance with our robots.txt.
  • Redistribute, re-host, sub-license, resell, or commercially reuse any creative, image, video frame, advertiser asset, or other third-party material displayed on the Service. The Service is for on-site editorial viewing; it is not a content-delivery or licensing channel.
  • Reverse engineer, decompile, or attempt to extract the source code or models behind the Service, except to the limited extent permitted by Article 100 of Spain’s Real Decreto Legislativo 1/1996 (Ley de Propiedad Intelectual) on decompilation for interoperability.
  • Probe, scan, or test the vulnerability of the Service without our prior written authorization, beyond good-faith vulnerability disclosure (please email info@luba.media).
  • Use the Service to violate any law, regulation, or third-party right, including intellectual property, trademark, privacy, or unfair competition laws.
  • Submit content through the contact form or any user-generated surface that is unlawful, defamatory, infringing, harassing, or fraudulent.

Visitor responsibility for downstream use. If you choose to download, screenshot, copy, save, share, or otherwise reuse any creative or third-party asset displayed on the Service, you do so on your own initiative, at your own discretion, and at your sole legal risk. You — not mediabuyer — are responsible for clearing any rights and obtaining any licenses required for that downstream use, and you alone bear any liability arising from it. Display on this editorial Service confers no rights on you with respect to third-party material.

We may suspend or terminate access for anyone who breaches this section, with or without notice, and we may pursue legal remedies including under Spain’s Ley 3/1991 de Competencia Desleal where applicable.

6. Our intellectual property

The original editorial text, original analysis, comparison frameworks, layouts, page templates, and the curated structure and selection of the ad index are owned by mediabuyer or licensed to us, and are protected under Spanish and EU intellectual-property law, including Real Decreto Legislativo 1/1996, EU Directive 2001/29/EC, and EU Directive 96/9/EC on the legal protection of databases (the database sui generis right applies to the index as a whole).

Subject to your compliance with these Terms, you are granted a limited, revocable, non-exclusive, non-transferable license to access the Service for personal, non-commercial reading, plus reasonable quotation under the right of citation (Art. 32 LPI), provided you attribute mediabuyer.site and do not create a substitute product. This license does not extend to any third-party advertiser creatives indexed on the Service — those remain governed by Section 4 above.

7. User submissions

When you submit a tip, correction, or other content through the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and publish that content for the purposes of operating and promoting the Service. You represent that you have the right to grant this license. You can withdraw this license for any future use by emailing info@luba.media.

8. Disclaimers and no warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, except for mandatory warranties owed to consumers under TRLGDCU. We do not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose. We make no representation or warranty as to the accuracy, completeness, currency, or reliability of any third-party advertiser creative, advertiser name, headline, statistic, or other content displayed on the Service. Information on the Service is for editorial, educational, and research purposes only and does not constitute legal, financial, tax, or compliance advice. You make your own buying, investing, and operational decisions.

9. Limitation of liability

To the fullest extent permitted by law, mediabuyer’s total aggregate liability arising out of or related to the Service shall not exceed one hundred euros (€100) or the amount you paid us in the twelve months preceding the claim, whichever is greater. We are not liable for indirect, incidental, consequential, special, or exemplary damages, including loss of profits or data. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud, gross negligence, willful misconduct, or for the mandatory rights of consumers under TRLGDCU and Spanish civil law.

10. Indemnification

You agree to indemnify, defend, and hold mediabuyer, its operators, contributors, affiliates, and licensors harmless from and against any and all third-party claims, demands, investigations, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your breach of these Terms;
  • your violation of any law or third-party right;
  • any download, copy, redistribution, re-hosting, or other downstream use, by you or anyone acting on your instruction, of any third-party creative, image, video frame, advertiser asset, trademark, or other material that you viewed on the Service, including any copyright, trademark, right-of-publicity, unfair-competition, or privacy claim asserted by the rights-holder of that material; and
  • content you submit to the Service via tips, corrections, forms, or any other channel.

mediabuyer reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defense. This clause survives termination of these Terms. Nothing in this section limits any consumer-protection rights that cannot be waived under TRLGDCU.

11. Termination

We may suspend or terminate your access at any time for breach of these Terms, lawful authority order, or operational necessity. You may terminate your account at any time by emailing info@luba.media. Provisions that by their nature survive termination (third-party content, IP, disclaimers, limitation of liability, indemnification, governing law) survive.

12. Governing law and dispute resolution

These Terms are governed by the laws of the Kingdom of Spain, without regard to conflict-of-laws principles. EU consumer-law mandatory protections of your country of habitual residence continue to apply where applicable.

Before initiating any formal dispute, you agree to contact us at info@luba.media and attempt a good-faith resolution. If unresolved within 30 days:

  • For consumers, exclusive jurisdiction lies with the courts of your place of residence within Spain or your EEA member state, as required by Regulation (EU) 1215/2012 (Brussels Ibis).
  • For non-consumer users, the parties submit to the exclusive jurisdiction of the courts of Madrid, Spain. The parties may elect arbitration administered by the Madrid Court of Arbitration (Corte de Arbitraje de Madrid) if both agree in writing.
  • EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes

We may update these Terms. Material changes will be highlighted and the "Last updated" date will be revised. Continued use of the Service after changes take effect constitutes acceptance.
